What Aravela Does
BITARCON S.R.L., which operates the Aravela platform, is a company registered in Romania under number [registration number], tax identification number [tax identification number], with its registered office at [registered office].
Aravela reviews hospitality professionals (cooks, waiters, bartenders, baristas, receptionists, housekeeping and event staff, among others) and introduces them to hotels, restaurants, cafés, bars and caterers. Through the platform we also prepare contracts, record timesheets, issue invoices and let everyone involved talk by chat, calls and meetings.
The terms of each engagement (who employs or contracts the professional, the work, the pay and the fees) are set in a separate written contract. If that contract and these Terms disagree, the contract applies.
Words We Use
- Job seeker:
- a person who has registered and is waiting for our review.
- Professional:
- a job seeker we have approved.
- Business:
- a hospitality company whose account we have approved, and the people who use Aravela on its behalf.
- Engagement:
- work a professional does for a business that was arranged through Aravela.
Accounts
- You must be at least 18 years old.
- Each person has one account. Do not share your password or let anyone else use your account; you are responsible for what happens in it.
- The information you give must be true, complete and kept up to date.
- A business account is opened only after we approve a request. The business decides which of its people use Aravela and removes their access when they leave.
- Tell us at once if you think someone else has used your account.
If You Are a Job Seeker or a Professional
- We review every application. We may ask you for an interview, ask for documents, or decline an application. Registering does not guarantee that we approve you or that you get work.
- Your profile is shown to businesses only after we approve and publish it.
- You must have the right to work in Romania (or in the country of the engagement) and hold any certificate the role needs, such as a valid occupational medicine certificate or food hygiene training.
- Keep your availability current, turn up for the shifts and interviews you accept, and tell us as early as you can if you cannot.
- Record your hours truthfully. A false timesheet is a serious breach.
- At a venue, follow its health and safety rules, hygiene rules and reasonable instructions, and treat guests and colleagues with respect.
- You must sign the Aravela non-disclosure agreement before your profile is published, and keep guest data, recipes, venue procedures and business information confidential.
If You Use Aravela for a Business
- Use Aravela only to find and work with staff for your own venues.
- Describe roles honestly and choose people without discrimination on grounds of gender, ethnicity, religion, disability, age or any other ground the law protects.
- Provide safe working conditions, the training a role needs and the information the law requires for staff working at your venue.
- Approve or dispute timesheets promptly. A timesheet you do not dispute within the period set in your contract counts as approved.
- Use the personal data of professionals only as our Privacy Policy and your non-disclosure agreement allow.
- Do not hire or engage a professional introduced by Aravela directly, or through another agency, during the period set in your non-disclosure agreement and contract, unless we agree in writing.
- Keep confidential the rates, fees and other commercial terms you receive from us.
Fees and Payment
Creating an account and applying is free for job seekers and professionals. Aravela never charges a job seeker a fee for finding work.
Businesses pay the fees set in their contract with Aravela [fee schedule]. We invoice according to approved timesheets and the contract. Invoices are due within [payment term] days. Late payment carries the interest Romanian law allows (Law 72/2013) unless the contract says otherwise.
Acceptable Use
You must not:
- use Aravela for anything unlawful, fraudulent or abusive;
- harass, threaten or discriminate against anyone in chat, calls or meetings;
- upload content you have no right to share, or files that contain malware;
- try to reach data or parts of the platform you are not allowed to see, or test its security without our written permission;
- copy profiles or other data out of Aravela in bulk, or use automated tools to collect it;
- take photos or recordings of other people on a call or at a venue without their permission.
Notifications
By giving us your email address and phone number you agree to receive service messages about your account and your work by email, text message and, if you allow it, push notification. You choose the optional ones in your notification settings. Messages needed for security or for a contract cannot be turned off while the account is open. Your mobile operator may charge for data or messages.
Content and Intellectual Property
What you upload (your profile, CV, photos, messages and documents) remains yours. You allow Aravela to store it, show it to the people who are entitled to see it under these Terms and the Privacy Policy, and adapt its format (for example, a CV page shown to a business) for as long as we provide the service to you and the law requires us to keep it.
The Aravela name, logo, design, platform and content belong to Aravela or its licensors. You may not copy, change or reuse them without our written permission.
Services of Others
Aravela relies on providers for hosting, email, text messages, push notifications and automated reading of CVs. We choose them with care but are not responsible for websites or services of others that Aravela links to.
Availability
We work to keep Aravela available and correct, but we cannot promise that it will always be available or free of errors. We may change, pause or stop parts of the service; where a change affects you significantly, we tell you in advance unless security or the law requires immediate action.
Liability
Aravela reviews professionals with care, but a business remains responsible for how it organises and supervises work at its venues, and each user is responsible for what they post and do.
To the extent the law allows, Aravela is not liable for indirect loss such as lost profit, lost business or lost data. Towards a business, our total liability in any 12 months is limited to [liability cap] or, if that is not set, the fees the business paid Aravela in those 12 months.
Nothing in these Terms limits liability for intent or gross negligence, for death or personal injury, or any right you have under mandatory law.
Suspension and Closing an Account
You may close your account at any time by writing to us. Engagements that are running end as their contracts say.
We may suspend or close an account that breaks these Terms, a contract or the law, or puts others at risk. We give notice and our reasons first, unless security, the law or the seriousness of the breach requires us to act at once.
After an account is closed we keep the data the law requires us to keep, as the Privacy Policy describes. Confidentiality, non-solicitation, payment and liability terms continue after closure.
Privacy
How we process personal data is described in our Privacy Policy, which forms part of these Terms.
Read the Privacy PolicyGoverning Law and Disputes
These Terms are governed by Romanian law. Please contact us first; most problems can be solved by talking. A dispute we cannot settle goes to the competent Romanian courts of the place of Aravela’s registered office, unless mandatory law gives you the right to go to another court.
Changes to These Terms
We may update these Terms. We publish the new version here with a new date and, for a change that affects you significantly, tell you at least 15 days before it applies. If you do not agree, you may close your account before then.
